近期看到新浪网刊出《吉祥三宝》抄法国《蝴蝶》的报道，沸沸扬扬，掀起了波澜。

《蝴蝶》是2002年法国公映过的一部电影的名字，主题曲与电影同名，法文名字叫做“LE PAPILLON”。这部影片的导演是法国以拍摄家庭喜剧而著称的菲利浦穆勒（Philippe Muyl），他在法国可谓家喻户晓。主演是获得过第三届凯萨影帝的著名演员米歇尔赛侯（Michel Serrault），和被称为法国天才童星的克莱尔·布翁尼诗。
影片剧情讲的是一个出生在单亲家庭的八岁的小女孩丽莎，一天中午放学，她的妈妈忘了接她回家，一个人安静地坐在咖啡馆里胡思乱想，小丽莎被脾气古怪的邻居爷爷发现。邻居爷爷是个收藏迷，他喜欢收集美丽的蝴蝶标本，爷爷说要到阿尔俾斯山上去寻找一种叫“伊莎贝尔”的欧洲最罕见、最美丽的蝴蝶。小丽莎因为找不到妈妈，又怕被人们送到孤儿院里去，就缠着爷爷带她一起去找世界上最美丽的“伊莎贝尔”蝴蝶，于是一老一小开始了奇妙而又新鲜的冒险之旅。
电影中的主题曲，就是这一老一小在冒险路上的风趣对话。邻居爷爷冷静肃穆，不苟言笑，小丽莎活泼可爱，总有问不完的话题。法国电影《蝴蝶》的歌词深入浅出，歌词中文大意是这样的：

为什么鸡会下蛋？因为蛋都会变成小鸡。

从以上的歌词当中，我们可以看出，《蝴蝶》的歌词充满童趣和纯真、它巧妙诙谐的背后蕴含着生活情趣和人生哲理。中国歌曲《吉祥三宝》的歌词我们大家耳熟能详，它更多的是通过大自然的描绘来传达家庭的温馨和人们对美好生活的吉祥与祈福。从两者歌词的意境方面来看，各有风情，姿彩迥异，应该谈不到什么雷同与抄袭。

我想人们之所以认为两者有抄袭之处，主要是两首歌曲的曲调和老小对唱的表达形式。在这里，我们先稍稍分析一下两者的旋律、节奏、配器、调式等音乐组成部分，也许能从当中找到两者雷同的蛛丝马迹。

法国《蝴蝶》的作曲为尼古拉·埃尔卡（Nicolas Errera），它在音乐中运用钢琴和弦乐铺陈为乐曲基调，歌曲采用的是西方大小调体系，整个旋律浪漫温馨，流畅舒展，节奏舒缓轻柔，娓娓道来。一个严肃的老人，一个活泼的孩子，两人一问一答，情趣盎然，对话简洁而深邃，伴随着音乐的层层深入，老少二人问答机智，互动和谐。歌曲的最后结尾使人感觉到这一老一小已经变成了有趣的搭档，在相互启迪，相互关爱中，踏上了走向大自然的旅程。

中国歌曲《吉祥三宝》取材于中国特有的民族调式——五声调式，它的旋律明亮跳跃，清脆甜美，节奏紧凑明快，轻灵自由，充分体现出了蒙古族人民热情、真挚和乐观向上的民族性格。特别是配器使用了蒙古族特有的民族乐器——马头琴，更使这首歌曲从旋律的优美而升华为意境的空灵苍邈，好似给人们带来一卷“天苍苍，野茫茫，风吹草低见牛羊”的草原图画。
更为重要的是，《吉祥三宝》歌曲里面充分运用了蒙古民族独具特色的长调音乐，长调一起，万物皆情，悠扬空灵，清澈隽永，把祥和氛围和祝福情怀抒发的淋漓尽致。听来似草原风吹，雄鹰展翅，一拍三叹，荡气回肠。

在《吉祥三宝》和《蝴蝶》之间，人们认为最为相似的，大概是因为他们都使用了“对唱”这一音乐形式，都以童声代表烂漫纯真，以浑厚的中低音色代表晚辈的慈祥与怜爱。说到“对唱”这种音乐形式，我想它并非中国独有，也不是只此法兰西一家。更确切地说，只要有民歌的民族，就会有这种音乐形式的存在。

关于抄袭问题，我说一个小插曲。2001年的春天，我的音乐会在巴黎举办，演出后法国国际广播电台、欧洲时报等媒体作了报道，一些法国音乐公司与我联络，希望商讨曲目出版的事宜。其中有一家法国大公司，他们通过朋友找到我，表示有意向合作，前提是要求先看看样带。我想到此公司的名声在法国不仅资历老，而且牌子足，他们应该不会有改头换面，偷梁换柱的作风出现。二是因为法国关于版权法律相对完善，即便有纠纷也会有相关法律来做保障，我于是将样带交给公司的来人。哪儿知道此事一去犹如泥牛入海，音讯全无。我几次打电话查询，结果都像羽毛扔进了大海一般悄无声息。

最后，我只有通过律师解决。律师告诉我，如果打官司，我们胜算的机会不大，因为我们没有任何证据。律师说不管是什么公司，都不应该给他们私自来人，都要公事公办，最起码要将样带通过邮局挂号寄出去，这样如果有了问题有据可查。律师也讲到，现今在西方国家，创作方面的纠纷是很难分辨，也极难解决。尤其在音乐创作方面，因为乐曲可以掐头去尾，前后倒换，或是只用主题，或者窃取创意主旨再加以变化等等，这都是很难说清楚的话题。由此我想到，我们国内从事作曲、编剧和作家以创作为职业的人们，他们在这方面的观念更为淡薄。随着中外的交流日益频繁，这些问题是必须要认真面对的。

我在这里想提醒大家，应该在创作的同时，更应该注重个人著作的权力。创作是基础，取证是先锋，即便是面对国外一些大机构或某些名家，也不能轻易一时脑热，全盘托出。应该谨而慎行，事情不到最后签合同，不应该让其得到对方所要的内容。首先要考虑到保护自己，然后再去与人谈判，这样即便产生纠纷，也有利于我们创作的一方。我们中国同行在这方面，恰恰表现出的常常感情大于理性，相信口头应承大于纸张合约者居多。以上所说，虽与《吉祥三宝》与《蝴蝶》关系不大，但愿给国内同行能起到抛砖引玉之功效吧。

我们将话题在回到《吉祥三宝》和《蝴蝶》。关于这两首歌曲，我个人以为，如果从它们的旋律、调性、和声、配器等音乐组成部分来看，是有些“相似之处”，但我们假如抛开音乐的内在结构，只分析两者的意境和情调，我们不难发现，这两首歌曲的灵魂部分是截然不同的。

法国歌曲《蝴蝶》的歌词诙谐，曲调纤雅，表达出的是法兰西民族地道的浪漫情怀。中国歌曲《吉祥三宝》词境祥和，旋律充满中国民间音乐色彩，抒发的是中国人特有的祥和氛围。尽管两首歌曲都是长辈与孩子的对话，一方历尽人生，一方旭日冉冉，他们在一问一答，一拍三叹的音乐里，诉说着对大自然的热爱和对未来的祝福，蕴藏着浓浓的亲情和富于哲理的人生感悟。但是探其根本，两者所表现的是各自不同的民族声音，中西百姓的民间情调。

我还以为，音乐之美也恰恰在此，音乐外在的音符音调只是它的表象形式，音乐素材的运用也不过是音乐的外在装璜。重要的是人们赋予了它思想和情感，音乐才因此承载起人们的爱恨情仇，喜乐悲欢，成为表达着人们的爱的语言，心之诉说。

我宁愿相信法国《蝴蝶》和中国《吉祥三宝》这两首歌曲，它们之所以能感动许许多多的中法听众，不是因为两者如何相互的“抄袭”，而是歌曲中孩子们如天籁般的童声和长辈们慈爱的温情，打动了中西大众的爱的心弦，才使人们潸然泪下，情思盎然。

法国《蝴蝶》与中国《吉祥三宝》广受中法听众喜爱，也恰恰证明了一点，音乐之美，是出自内心，也能深入人心的的。
